DUNGANNON PETTY SESSIONS

The fortnightly Petty Sessions were held on Monday. The magistrates present were – Mr. Newton (chairman), Dr. Elliott, Mr. Brown and Col. Burges.

DRUNKENNESS &c.

Sub-Constable Kidney charged Wm. Fitzgerald and James Magill with being drunk on the 2nd April. They were each fined 2s 6d and costs.

Sub-Constable John O’Donnell charged James Nugent and John Bergin with drunkenness on in the 2nd inst., and they were each fined 2s 6d and costs.

Constable Plant charged Thomas Byers alias Morrow with a like offence. Defendant did not appear and a fine of 5s and costs was inflicted.

Constable Roe charged Michael Parkes and John Donaghey with being drunk on the public street. Fined 2s 6d and costs

Lawrence Finnegan was charged by Acting-Constable Toman with being drunk. Fined 2s 6d and costs.

Sub-Constable Wm. Hyland charged Wm. Ferry with a like offence at Donaghmore. Fined 2s 6d and costs.

THE RIOT AT COALISLAND

Constable Wisley charged Robert Kettle with riot at Coalisland on Easter Monday but the hearing of the case was adjourned until next Petty Sessions, the defendant being bound over himself on £10 and two sureties in £5 each to appear.

ASSAULT

Jane McMenamy charged Margaret O’Rorke with assault at Stevenson’s Row. A fine of 2s 6d and costs was inflicted.

Thomas McDowell brought a charge of assault against Hugh McCrory.

Mr. Simmons appeared for the plaintiff.

There was also a cross charge of assault by McCrory against McDowell. Both cases were heard together on the suggestions of Mr. Simmons

Thomas McDowell examined by Mr. Simmons I was attending masons in Sloan Street, on the 18th March last - carrying mortar to them. McCrory was in Mr. Hutchinson’s garden and he fell off a stack of straw. - - He came over to me and ask me what I was laughing at. He said he would not speak to a man who carried mortar and said he would beat any of us. I threw a small quantity of mortar on him and he struck me. I struck him again and he fell against a window sill and hurt himself.

To McCrory – I could see where you fell as it was next the corner where you fell I was working.

Other witnesses were examined as to the row, which commenced by McCrory being angry at the masons and others laughing at him for falling off the stack. McDowell threw mortar on McCrory who struck him in return. McDowell then struck him of pushed him and he fell against the window sill and cut himself. It was after McCrory said he could beat any anyone on the scaffold that McDowell threw the mortar on him. One witness named Cullen said he saw McDowell beat and kick McCrory when he was down.

The Chairman said his brother magistrates agreed with him that these cases should not have come before the court at all. They were both dismissed.

DESTROYING TIMBER

Washington Kinley, Bloomhill charged Anthony Sloan of Stughan, a young lad with cutting an ash sapling and carrying it away. The ash was growing on the plaintiff’s lands and defendant was found in the act of carrying it away. There were many trees cut locally and the object of the prosecution was to deter people from injuring the trees on the Bloomhill property.

Defendant’s father appeared and he said he had punished his delinquent son for the offence.

The Chairman warned the defendant against any further offence of this kind and fined him 1s and costs.

THE AGRARIAN OUTRAGE NEAR COALISLAND

The man, Joseph Kelly, arrested on the charge of shooting into the dwellinghouse of Mr. King, Annesley Lodge, was brought before the court but the hearing of the charge was adjourned.

Mr. Reynolds was solicitor for the accused.

The other cases before the Court were processes for small debts such as county cess, &c.
