Indicted for that he with others riotously assembled at Coal Island, and did then and there prevent the loading of a boat with a quantity of potatoes. The HON. BARON PENNYFATHER, before whom he was tried, read the Act of Parliament, and explained it to the full extent, showing that the indictment under which the prisoner was given in charge, was capital, and if found guilty, he should forfeit his life. After a long explanation, the Jury retired, and in a few minutes returned a verdict of guilty, at the same time recommending the prisoner to mercy, as they were of opinion, that he, with the others connected in the commission of the offence, were not aware of the penalties of the law on such occasions, and it being the first offence of the kind ever tried in Omagh. The Judge received the recommendation, and sentence of death was recorded against the prisoner. His Lordship stated that he would communicate with Government; but at the same time the prisoner need not expect anything less than transportation for life |
